In a contested Family Law case, the Court may appoint a Guardian ad Litem (GAL) to focus on the best interests of the minor child(ren), and to assist the Court in ascertaining the child(ren)’s concerns, desires and needs with regard to the issues before the Court. When a GAL is appointed, the GAL represents the best interests of the child(ren) and is neutral (does not represent either party). Shelly is regularly appointed as a GAL by the Court.
The Guardian ad Litem is responsible for investigating and reporting factual information regarding the issues ordered to be reported or investigated to the Court. The GAL may make recommendations based upon her investigation. The GAL reports the child(ren)’s expressed preferences regarding his/her/their custody to the court, together with the facts relative to whether any preferences are being expressed voluntarily and the degree of the child(ren)’s understanding.
The Guardian ad Litem is required to provide a full and complete written report to the court. The report usually includes recommendations and bases for those recommendations.
